1. Acceptance of Terms

By accessing this website, purchasing products, opening a commercial account, or receiving services from MT Axle Supply LLC (“MT Axle Supply,” “we,” “us,” or “our”), you agree to be legally bound by these Terms & Conditions.

If you do not agree, do not use this website or purchase our products or services.

MT Axle Supply provides trailer parts, axles, suspension components, brake systems, electrical components, trailer repair, inspections, and related mechanical services.

Product availability, pricing, specifications, and fitment information are subject to change without notice.

We reserve the right to:

• Correct errors in pricing or descriptions
• Cancel orders resulting from typographical or inventory errors
• Limit quantities

3. Orders, Payments & Special Orders

Payment is due at time of purchase unless prior written credit terms have been approved.

Commercial accounts are governed by separately executed written credit agreements, including Net 30 terms due by the 10th of the month and 2% monthly finance charges on unpaid balances.

Special-order or custom-built items:

• May require a minimum 50% non-refundable deposit
• Are not eligible for return
• Cannot be cancelled once production or procurement has begun

Prices do not include applicable taxes unless stated.

4. Returns & Refunds

Returns require prior approval and are subject to our Return Policy.

5. Installation Responsibility & Assumption of Risk

Many products sold by MT Axle Supply are load-bearing and safety-critical components.

Buyer acknowledges and agrees:

• Proper installation is solely the responsibility of the purchaser or installer.
• Installation should be performed by a qualified professional.
• All manufacturer specifications and weight ratings must be followed.
• Fitment verification is the buyer’s responsibility.

MT Axle Supply is not liable for damages resulting from improper installation, misuse, overloading, modification, or pre-existing equipment conditions.

Buyer assumes all risks associated with installation and use.

6. Freight Shipments & Inspection

For freight deliveries (including axles), customers must inspect shipments at delivery and note any visible damage on the Bill of Lading before signing.

Failure to do so may void damage claims and releases MT Axle Supply from responsibility for shipping-related damage.

7. Warranties

Products may carry manufacturer warranties. MT Axle Supply does not provide additional warranties beyond those expressly stated in writing.

To the fullest extent permitted by law, all implied warranties are disclaimed.

8. Limitation of Liability

To the fullest extent permitted by law:

MT Axle Supply shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of revenue, downtime, or profits
• Oilfield contract penalties
• Towing expenses
• Property damage or personal injury arising from misuse or improper installation

Total liability shall not exceed the purchase price of the product or service giving rise to the claim.

Exclusive remedy is limited to repair, replacement, or refund at our discretion.

9. Binding Arbitration & Dispute Resolution

Any dispute arising from purchase or use of products or services shall be resolved exclusively through binding arbitration in the State of Montana.

The parties agree to:

• Waive the right to a jury trial
• Waive participation in class or collective actions
